Definitions

"MedicalMissions.com" includes the MedicalMissions.com website or any of its supporting applications, interfaces and websites.

"Content" includes any text, ideas, stories, quotes or other non-identifying information, as well as images or other media that is posted to MedicalMissions.com by you or someone using your account or login.

"Identifying Information" includes your name, address, phone number, email address, password and any other information of a personal nature that may initially or over time be entered into MedicalMissions.com for the purpose of securing MedicalMissions.com or contacting you.

Agreement

By using or accessing MedicalMissions.com, you agree to the following:

Content and Information

Any Content, as defined above, entered into MedicalMissions.com becomes the property of Southeast Christian Church/MedicalMissions.com and may be used at the discretion of Southeast Christian Church/MedicalMissions.com for display to other users, display on websites and/or applications, as well as in marketing materials or promotion of the website to other users, investors and advertisers.

Southeast Christian Church/MedicalMissions.com must approve all Content prior to it being displayed in any website or application. Consequently, you agree not to upload any Content to MedicalMissions.com of any of the following type or description:

  1. Proprietary information of any company or business that you do not have the right to distribute.
  2. Copyrighted information of any organization or individual where you do not hold the copyright.
  3. Images or other media that are not of a royalty-free or public domain nature.
  4. Unauthorized commercial communications, such as spam or advertising for the selling or promotion for selling a product, company or business.
  5. Unlawful multi-level marketing or solicitation for the purpose of signing up or registering for any promotion, business or other opportunity not related to MedicalMissions.com.
  6. Information that is misleading, false, untrue or inaccurate.
  7. Promotion of one specific business entity over another business entity of the same or similar type where you stand to gain or profit from such promotion.
  8. Verbiage that uses foul or offensive language or references.
  9. Verbiage that attempts to bully, intimidate or harass another user.
  10. Verbiage that is hateful, threatening or pornographic in nature.
  11. Information that incites violence or contains nudity or graphic or gratuitous violence of any kind, or references to participation in or initiation of illegal activity.
  12. Contests, giveaways, sweepstakes or any type of promotion.
  13. Verbiage or media that is unlawful, misleading, malicious or discriminatory.
  14. Verbiage that infringes upon or violates someone else's rights, or includes personal information or identifying information of another person without the express permission of that person.
  15. Links to websites or other applications that violate any of the conditions listed above.
  16. Information about events, gatherings or locations where illegal activity takes place.

Southeast Christian Church/MedicalMissions.com at its sole discretion reserves the right to delete or alter any material that is in violation of the guidelines above or that cannot be explicitly confirmed or validated using reasonable efforts.

Southeast Christian Church/MedicalMissions.com at its sole discretion reserves the right to block or remove your access to MedicalMissions.com due to a violation of the guidelines above.

Southeast Christian Church/MedicalMissions.com is not liable or responsible for any Content you provide that Southeast Christian Church/MedicalMissions.com is unable to explicitly determine to be in violation of the guidelines above.

Registration and Account Security

If you choose to register on MedicalMissions.com by creating an account, you agree to the following stipulations:

  1. You will provide your real and accurate email address and other contact information.
  2. You will not provide any false personal information or register as someone other than yourself with the express permissions of that other person.
  3. You will not create more than one account for yourself.
  4. You will not share your password with anyone else or let anyone else access your account.
  5. You will not use MedicalMissions.com if you have been convicted of any crime against property or against another person, including if you are a sex offender.

Use of Information

Information provided through MedicalMissions.com is designed to assist individuals and groups in developing ideas for activities by providing a forum type of environment. Southeast Christian Church/MedicalMissions.com does not guarantee the validity or accuracy of information or ideas that appear on MedicalMissions.com and does not promote or encourage the use of such information or ideas for any reason.

You agree not to hold Southeast Christian Church/MedicalMissions.com liable or responsible for any actions you take or decisions you make as a result of any information or ideas obtained on MedicalMissions.com.

General Speaker Policy

I agree to Representation & Intent Policy: Representing the global intent of health missions over my personal agenda or agenda of the organization I represent. Medicalmissions.com is not responsible for content and practices provided in any piece of content and media within.

I agree to the Team Teaching Policy: Some sessions may be taught by more than one person. Sessions that are taught by more than one person will most likely only be noted by the main presenter. CME accreditation will be based on the credentials of the main presenter. Speaker stipends are only available for the main presenter. Panel sessions may also only note the host or primary presenter as well.

I agree to the Rights to Record Policy: By accepting an invitation to speak all participants are granting the rights for the GMHC to record sessions and reproduce information for wider distribution as follows below. Please make the GMHC aware of any potential security issues that may be related to your session and its public posting through online platforms. Speakers agree to terms in acceptance of speaking.

I agree to the Selling/Recording Policy: GMHC may in its discretion duplicate and/or edit each recorded session. Speaker hereby grants GMHC and its assigns the non-exclusive right to make, sell or otherwise distribute copies of the recording in mp3, mp4, CD, DVD, or other appropriate electronic format, and in written transcript form, and to use my name and likeness in connection with such copies. The Session may be podcast, viewed and /or downloaded worldwide, via the worldwide web or on radio or closed-circuit broadcast. GMHC shall have no obligation to pay royalties or other compensation to Speaker in connection with recording, duplication, display, showing, broadcasting (internet or otherwise), sale, distribution, sub-licensing, or any other use of the recording as set forth in this Policy. GMHC and its assigns shall be permitted to display/show the recording or parts thereof at all times.

I agree to the Permissions Policy: I give Southeast Christian Church (SCC), the host church of the Global Health Missions Conference (GHMC), and any person acting under its authority, permission to publish, distribute, broadcast, televise, promote, license, sell, and copyright for educational or commercial, and related promotional purposes, any photograph, videotape, motion picture, or sound recording produced directly by SCC or under its sponsorship, which may include the image or likeness of me. I also authorize SCC to reproduce, amplify, simulate, filter, or otherwise distort my voice and all instrumental, musical, and other sound effects produced by me. In addition, I authorize the use of any printed material in connection therewith. I release all claims against GHMC and SCC with respect to copyright ownership and publication. I agree that I shall not receive any fee and that all rights, title, and interest to the above materials and use of them belong to SCC. I understand and agree that these materials may be duplicated or distributed with or without charge, and/or altered in any form or manner without future/further compensation or liability, in perpetuity. I understand that SCC is obtaining this release and assignment of copyright in order to conform to U.S. copyright laws and international copyright treaties and conventions.

Media Policy

1. Your Acceptance

By using or visiting the Southeast Christian Church / medicalmissions.com website or any Southeast Christian Church / medicalmissions.com products, software, webware, and services provided to you on, from, or through the Southeast Christian Church / medicalmissions.com website (collectively the "Service") you signify your agreement to (1) these terms and conditions (the "Terms of Service"), (2) Southeast Christian Church / medicalmissions.com's privacy notice, and also incorporated herein by reference. If you do not agree to any of these terms, the Southeast Christian Church / medicalmissions.com privacy policy, or the Community Guidelines, please do not use the Service.

Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version. Southeast Christian Church / medicalmissions.com may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.

2. Service
These Terms of Service apply to all users of the Service, including users who are also contributors of Content on the Service. “Content” includes the text, software, scripts, graphics, photos, sounds, music, media resources, audiovisual combinations, interactive features and other materials you may view on, access through, or contribute to the Service.

The Service may contain links to third party websites that are not owned or controlled by Southeast Christian Church / medicalmissions.com. Southeast Christian Church / medicalmissions.com has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Southeast Christian Church / medicalmissions.com will not and cannot censor or edit the content of any third-party site. 3. Southeast Christian Church / medicalmissions.com Accounts

You agree not to distribute in any medium any part of the Service or the Content without Southeast Christian Church / medicalmissions.com's prior written authorization, unless Southeast Christian Church / medicalmissions.com makes available the means for such distribution through functionality offered by the Service (such as the Embeddable Player).

You agree not to alter or modify any part of the Service.

You agree not to access Content through any technology or means other than the media resource playback pages of the Service itself, or other explicitly authorized means Southeast Christian Church / medicalmissions.com may designate.

You agree not to use the Service for any of the following commercial uses unless you obtain Southeast Christian Church / medicalmissions.com's prior written approval: the sale of access to the Service; the sale of advertising, sponsorships, or promotions placed on or within the Service or Content; or the sale of advertising, sponsorships, or promotions on any page of an ad-enabled blog or website containing Content delivered via the Service, unless other material not obtained from Southeast Christian Church / medicalmissions.com appears on the same page and is of sufficient value to be the basis for such sales.

Prohibited commercial uses do not include: uploading an original media resource to Southeast Christian Church / medicalmissions.com, or maintaining an original channel on Southeast Christian Church / medicalmissions.com, to promote your organization or artistic enterprise; any use that Southeast Christian Church / medicalmissions.com expressly authorizes in writing.

5. Your Use of Content

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of Content.

The Content on the Service, and the trademarks, service marks and logos ("Marks") on the Service, are owned by or licensed to Southeast Christian Church / medicalmissions.com, subject to copyright and other intellectual property rights under the law.

Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these Terms of Service. You shall not download any Content unless you see a “download” or similar link displayed by Southeast Christian Church / medicalmissions.com on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Southeast Christian Church / medicalmissions.com or the respective licensors of the Content. Southeast Christian Church / medicalmissions.com and its licensors reserve all rights not expressly granted in and to the Service and the Content.

You agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.

You understand that when using the Service, you will be exposed to Content from a variety of sources, and that Southeast Christian Church / medicalmissions.com is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content. 6. Your Content and Conduct

As a Southeast Christian Church / medicalmissions.com account holder you may submit Content to the Service (depending on type of account), including media resources and user comments. You understand that Southeast Christian Church / medicalmissions.com does not guarantee any confidentiality with respect to any Content you submit.

You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to Southeast Christian Church / medicalmissions.com all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Service.

For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to Southeast Christian Church / medicalmissions.com, you hereby grant Southeast Christian Church / medicalmissions.com a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Southeast Christian Church / medicalmissions.com's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in media resource Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your media resources from the Service. You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant Southeast Christian Church / medicalmissions.com all of the license rights granted herein.
You further agree that you will not submit to the Service any Content or other material that is contrary to the Southeast Christian Church / medicalmissions.com Community Guidelines, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.

Southeast Christian Church / medicalmissions.com does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Southeast Christian Church / medicalmissions.com expressly disclaims any and all liability in connection with Content. Southeast Christian Church / medicalmissions.com does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and Southeast Christian Church / medicalmissions.com will remove all Content if properly notified that such Content infringes on another's intellectual property rights. Southeast Christian Church / medicalmissions.com reserves the right to remove Content without prior notice.

7. Account Termination Policy

Southeast Christian Church / medicalmissions.com will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer.

Southeast Christian Church / medicalmissions.com reserves the right to decide whether Content violates these Terms of Service for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, or excessive length. Southeast Christian Church / medicalmissions.com may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user's account for submitting such material in violation of these Terms of Service.

8. Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, SOUTHEAST CHRISTIAN CHURCH / MEDICALMISSIONS.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. 9. Limitation of Liability

IN NO EVENT SHALL SOUTHEAST CHRISTIAN CHURCH / MEDICALMISSIONS.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

YOU SPECIFICALLY ACKNOWLEDGE THAT SOUTHEAST CHRISTIAN CHURCH / MEDICALMISSIONS.COM SHALL NOT BE LIABLE FOR CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

The Service is controlled and offered by Southeast Christian Church / medicalmissions.com from its facilities in the United States of America. Southeast Christian Church / medicalmissions.com makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

10. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Southeast Christian Church / medicalmissions.com, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

11. Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the Service is not intended for children under 13. If you are under 13 years of age, then please do not use the Service. There are lots of other great web sites for you. Talk to your parents about what sites are appropriate for you.

12. Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Southeast Christian Church / medicalmissions.com without restriction.

13. General

You agree that: (i) the Service shall be deemed solely based in Kentucky; and (ii) the Service shall be deemed a passive website that does not give rise to personal jurisdiction over Southeast Christian Church / medicalmissions.com, either specific or general, in jurisdictions other than Kentucky. These Terms of Service shall be governed by the internal substantive laws of the State of Kentucky, without respect to its conflict of laws principles. Any claim or dispute between you and Southeast Christian Church / medicalmissions.com that arises in whole or in part from the Service shall be decided exclusively by a court of competent jurisdiction located in Santa Clara County, Kentucky. YOU AND SOUTHEAST CHRISTIAN CHURCH / MEDICALMISSIONS.COM AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
